User agreement between the user (customer) and the Ferry GateWay OnLine Inc.  Please read these terms and conditions of use (Terms and Conditions) carefully before using this Site and making any booking.

You consent to the Terms and Conditions when you use the Site, without qualification. If you disagree with any part of the Terms and Conditions, you may not use the Site in any way or make a booking.

The Ferry GateWay OnLine Inc reserves the right to change or update the Terms and Conditions relating to use of the Site from time to time without prior notice to Users. Continued use of the Site following any changes to the Terms and Conditions shall constitute your acceptance of such changes.

In order to provide ferry bookings The Ferry GateWay OnLine Inc requires the submission of personal details including names, addresses, passport numbers and payment details to successfully complete a travel booking.
This information is collected to comply with custom and coast guard regulations and is maintained on our database to enable us to amend, cancel or update your relevant information. We absolutely do not share your information.
Other information such a your credit card number is used only to the extent necessary to complete or amend your requested transaction - ie we use that card to collect payment from or refund to your credit card provider. All information provided to us is stored in a password protected environment and is available only to authorized personnel

Reservations
Once a booking has been made on the Site and full payment received, The Ferry GateWay OnLine Inc, will issue you an email noting and reiterating the details of your booking request. This will be followed within 36hrs by a 2nd email containing the ferry operators booking confirmation number. This number, along with all relevant photo I.D. must be presented on check in and prior to boarding so you can receive your tickets. Passengers shall be solely responsible for obtaining all necessary travel documents. If all components of your ferry booking request can not be filled, you will be contacted by phone and/or email to either void your online booking request ( at no charge to you) or to discuss available options. Bookings can be made by credit or debit card and credit card charges may be applied to certain cards by your bank. 

Cancellations
Reservation cancellation charges vary by operator but are typically charged at 25% when a cancellation is made more than 35 days in advance of travel commencement; 30% when the cancellation is made 18-34 days in advance of travel; 35% when the cancellation is made 11-17 days in advance of travel and 45% when the cancellation is made 2-10 days in advance of travel. Cancellations made within 48 hrs of a sailing or a no show will result in a penalty equal to 55% of the booked space value. Some operators will not provide refunds if a cancellation is received within 30 hrs of departure.

Amendments

Reservation change fees are applicable when an itinerary decreases in value. Fees are applicable as follows:

Greater than 35 days from sailing - 20% fee on decrease in value; 18-34 days from sailing - 25% fee on decrease in value; 7-14 days from sailing - 25% fee on decrease in value; 2-10 days from sailing - 45% fee on decrease in value. Within 48 hours from sailing - 55% fee on decrease in value

All fees /charges described in the Terms & Conditions comprise a part of any booking agreement.

All fares are based on the mode of transportation, vehicle type, size, number of passengers, route(s), departure times, travel period and dates of travel and are subject to availability.
Some fares are subject to limited facilities or services including no on-board accommodation, the facility to take vehicles, dimension of vehicles, number of passengers or no facilities for pets. Please check before booking.


Military Bookings

Pets
The transport of pets between the USA and Canada must be in accordance with the relevant requirements of the countries concerned and a fee is payable on some services. Please check before booking and always seek advice from your vet.
Pets must remain on the car decks of most vessels, and be cared for by their owners. Pets are not allowed above the car deck or in passenger cabins. Owners may visit their pets on the car deck. When travelling on the AMHS (Alaska Marine) pet calls are announced by the purser approximately three times a day on longer sailings between Bellingham and Ketchikan, and between Juneau and Whittier.

The Ferry GateWay OnLine Inc provides a virtual booking functionality and on completion & acceptance of your booking request you will instantly receive a record reference number by email. That email will be followed within 36 hrs by a confirmation number which must be presented to the appropriate ferry operator on check-in ( Bookings are cross referenced with the lead passenger name so if the confirmation # is lost/forgotten, the booking is still accessible. )

The Ferry GateWay OnLine Inc reserves the right to vary the cost of fares according to changes in the market (e.g. currency fluctuations, oil prices and government legislation) or operator price rises.

The Ferry GateWay OnLine Inc is not liable if you miss your departure, misuse the terms of booking or, overstay the travel period your booking allows.

All departure/arrival times are provided by the Operator/s and are given in local military (24 hr) time.  It is advisable to check for departure time changes before departing.
It is important to call your port of departure in advance of your sailing date to ensure that the sailing is on time, that the schedule has not changed, and that there has been no Itinerary detail error

The Ferry GateWay OnLine Inc can not accept liability for any interruptions or changes to your travel due to adverse weather or tidal conditions. Customer services will attempt to notify you of any serious conditions that may affect your travel, but please check the travel conditions with your departure terminal prior to check-in time.
The Ferry GateWay OnLine Inc can not accept liability for any interruptions, changes or cancellations to your travel due to vehicle failure, medical issues or other circumstances.

The Ferry GateWay OnLine Inc can not accept liability for changes to the service including the use of alternate ships or the withdrawal of on-board facilities and services.

Operator Terms and Conditions of Passage

BC FERRIES: Conditions of Passage When Travelling on BC Ferries (BCF)
Conditions of Carriage
1. Carriage of passengers and their luggage, including their vehicles, shall be pursuant to the Marine Liability Act, S.C. 2001, c.6 and amendments thereto and all terms defined in such Act shall have the same meanings under these conditions.
2. No Bill of Lading is issued in respect of this carriage and the Hague-Visby Rules do not apply.
3. The Carrier shall not be responsible for any loss, damage or inconvenience suffered by any passenger resulting from late, delayed or cancelled sailings, arrivals or departures regardless of the cause or from any change or deviation in any schedule of sailing times from those published by the Carrier.
4. All fares, tariffs or surcharges are subject to change without notice. Cost of carriage is subject to changes in fares, tariffs or surcharges effected prior to carriage, such increased amounts to be paid prior to boarding.
5. In order to protect the health, safety, security and comfort of its passengers, the Carrier reserves the right to refuse transportation to any person, vehicle, article or goods or to remove same from any vessel, or from any terminal or other property occupied by the Carrier. The Carrier�s Rules and Requirements for terminal operations and carriage are available from any terminal manager and are posted on the Carrier�s website at bcferries.com. The Carrier is under no obligation to accept for carriage any luggage or accept any vehicle, article or goods which do not meet its requirements with respect to identification or condition. The Carrier has the right, but not the obligation, to verify in the presence of the passenger the contents of luggage, and, to open and examine such luggage whether or not the passenger is present.
6. For good order and security, passengers agree to follow the directions of any employee of the Carrier in respect of use or operation of the terminal or vessel. When requested by any employee, passengers will provide proof of identification satisfactory to the Carrier and will answer any enquiry and produce any documents requested by the employee in respect to any luggage, vehicle or its contents. Persons who refuse to provide information or documentation as required; who refuse to follow directions of any employee, sign or device in any terminal or on board any vessel; who interfere with or molest other passengers; who interfere with the operation of a terminal or vessel; or who interfere with any employee of the Carrier, may be refused passage, ordered off the vessel and evicted from the terminal. The Carrier will rely on section 83 of the Canada Shipping Act, 2001, S.C. 2001, c.26 and amendments thereto and section 494(2) of the Criminal Code of Canada, R.S.C. 1985, c. C-46 and amendments thereto to maintain good order and discipline.
7. Any and all costs incurred by the Carrier in respect of any luggage or vehicle left unattended or in an unauthorized location or for non payment of fees or expenses shall be

for the account of the passenger and the Carrier shall have a lien on such luggage or vehicle for such amounts. If the owner or driver of any vehicle does not drive the vehicle on or off its vessel in accordance with the directions of the Carrier, then the Carrier may remove the vehicle from the vessel at the sole risk and expense of the owner or driver. The Carrier shall not be liable for any damage caused by or to such vehicle or its contents even if caused by the Carrier�s negligence.
8. No vehicle shall be deemed to have been taken over by the Carrier until such vehicle is permanently at rest on board the vessel prior to sailing and shall be deemed to be redelivered by the Carrier on commencement of discharge from the vessel. At all other times, vehicles are under the care, custody and control of the owner or driver of the vehicle and responsibility for any loss or damage to or by the vehicle shall be with the owner or driver of the vehicle, notwithstanding any direction given by the Carrier in respect of that vehicle. The owner or driver of the vehicle is responsible for properly securing the vehicle and its contents throughout the voyage. The Carrier is not responsible for theft of the vehicle or of its contents, or for damage to any vehicle not due to the negligence of the carrier.
9. For the purpose of these Conditions of Carriage, the Carrier includes every agent, servant and employee of the Carrier and any corporation owned by, subsidiary to or associated or affiliated with the Carrier, including every independent contractor from time to time employed by the Carrier and every right of whatsoever nature applicable to the Carrier or to which the Carrier is entitled hereunder or by statute or common law shall also be available and shall extend to each of them.
10. The Carrier shall not be liable for any loss, detention, damage, injury causing death or illness caused to or by live animals however or wherever such loss, detention, damage or injury occurs even though caused by any act, neglect or default of the Carrier.
11. The Carrier shall not be liable for the quality, nature or consequence of any medical or surgical treatment or assistance which may be administered, notwithstanding that the said medical or surgical treatment or assistance is done negligently. Passengers are required to advise the Carrier of any and all health issues or concerns prior to entering into the contract of carriage.
12. The Carrier may amend these Conditions of Carriage at any time.

CLIPPER FERRIES (CLIP) : Terms and Conditions For Travel on Clipper Ferries
TARIFF RULES AND DEFINITIONS
� Fares are subject to change without notice and may include local or federal taxes where applicable in the U.S. and Canada.
� All special fares are subject to rules and conditions of carriage as defined by the Company.
� Rescheduling service charge per person may be assessed on every ticket issued.
� The company reserves the right to refuse to refund any portion of a ticket that is mutilated, lost or stolen.
� The Company reserves the right to refuse carriage to any passenger holding a valid ticket, and will refund any unused portion of the ticket.
� A child is defined as any person 1 through 11 years of age.
� A senior citizen is defined as any person 65 years of age or over.
� These fares are subject to change with major fluctuations in the exchange rates (see current published brochure).
� Fuel surcharges may be applied to all transportation fares.
� All dollar amounts listed in these rules and regulations are in U.S. dollars unless otherwise noted.
� A separate cancellation policy applies to group bookings, advance purchases fares and tour packages. There is no refund on unused portions of a reservation.

RULE NUMBER 1 � DEFINITIONS
EFFECTIVE 15 JANUARY 2015
1.1 One � Way
Any trip that has completed one leg of travel in any direction and terminates in a city that is not the city of origin.
1.2 Round Trip/Return
Any trip that has completed at least two legs of travel, one in either direction, and returns to the city of origin will be classed as a round trip.
1.3 Group
15 persons or more traveling together on all segments of the trip will be classed as a group.
1.4 Charter
Any group or individual that will use 100% of the seats of the vessel will be considered a charter, subject to vessel availability.
1.5 Adult
Any person that has reached their 12th birthday at time of travel will be considered an adult for tariff purposes.
1.6 Senior Citizen
Any person that has reached their 65th birthday at time of travel will be considered a senior citizen for tariff purposes.
1.7 Child
Any person that has reached 1 year of age through 11 years of age at time of travel will be considered a child for tariff purposes.
1.8 Infant
Any person that has not reached 1 year of age at time of travel will be classed as an infant for tariff purposes.
1.9 Service Charge
A non-refundable re-ticketing and reschedule charge of $15.00 may be applicable to every ticket issued.
1.10 Currency
All tariffs and charges will be in either Canadian or American dollars (Cash). The Company will accept either currency as payment providing the entire ticket is paid for in the same currency.
1.11 Schedules
The Company reserves the right to change or alter the schedule to meet traffic demands.
1.12 Credit Card Usage
Credit cards are accepted as a form of payment. The charge will be applied to the card in US funds and the credit card issuer will convert the purchase into the card�s issuing country�s currency.

RULE NUMBER 2 � SPECIAL FARES � DEFINITION AND DESCRIPTION
EFFECTIVE 15 JANUARY 2015
All reduced fares must be requested at time of reservation.
All special fares are subject to conditions for travel established by the Company.
Special fares will only be applicable on certain dates, departures, and seat availability may be limited.
2.1 Group Travel
-The group must be pre-paid at least 30 days prior to travel with single payment.
-All members of the group must travel together on all segments.
-A group rate ticket is valid only for the trip it was issued.
-Group rate tickets are non-refundable and nontransferable
� With more than 15 days notice of cancellation, a group may receive a 50% refund. Cancellations received within 14 days and no-shows will be subject to forfeiture of the entire fare. A separate cancellation policy applies to accommodation packages.
2.2 Charter Travel
-The full amount of the applicable tariff for chartering the vessel must be paid per
contractual arrangement.
-Charter tickets are non-refundable.
-The request for charter must be made in writing stating all of the pertinent detail
to the Sales Office, Attention: Group Sales Manager.
-A signed Transportation Charter Agreement is required for all charters.
2.3 Business Class
-The Company may elect to establish a business class.
2.4 Advance Purchases
-Non-refundable transportation tickets must be purchased at time of booking according to specific rules for each fare. Strict voyage and date restrictions apply and may vary by date and fare.
2.5 Family Plan
-Discounted rate may apply for children traveling with a guardian (s) paying the adult fare. See current brochure. This fare is not available for groups.
2.6 Child Fare
Is applicable for children traveling with adults but not eligible for the Family Plan. Unaccompanied children (ages 8 � 11) will pay the current published fare for an adult.

2.7 Frequent Travelers
-Individuals may sign up as part of the company�s Frequent Traveler program. Frequent Travelers who accumulate 200 points qualify for a free round trip ticket after submission and review of proof of travel.

RULE NUMBER 3 � IDENTIFICATION REQUIREMENTS FOR CUSTOMS & IMMIGRATION
EFFECTIVE 15 JANUARY 2015
3.1 Proof of citizenship is required for Customs and Immigration.
-U.S. or Canadian citizens are required to have a passport, Passport Card, Enhanced Driver License or an Enhanced ID Card. A passport is required for air travel.
-U.S. or Canadian children under the age of 16 can travel with a birth certificate or naturalization certificate.
-Passengers who are not citizens of the U.S. or Canada must have a passport and may also require a visa.
-Responsibility for ensuring proper documentation rests with the passenger.
-A felony may be a cause for denied entry into Canada. A D.W.I. (Driving while intoxicated), or D.U.I. (Driving under the influence) is considered a felony in Canada.
3.2 Passengers shall be solely responsible for obtaining all necessary travel documents. The company shall not be liable for any aid or information given by any agent or employee to passengers in connection with obtaining such documents.
3.3 Passengers shall pay the applicable fare whenever the company, on government order, is required to return a passenger to point of origin or elsewhere due to the passenger�s inadmissibility into or deportation from a country, whether in transit or destination.

RULE NUMBER 4 � TICKET VALIDITY AND TICKETING TIME LIMITS
EFFECTIVE 15 JANUARY 2015
4.1 The Company reserves the right to establish advance purchase ticket time limits.
4.2 The Company reserves the right to automatically cancel any reservation that has not met the advance purchase ticket time limit.
4.3 The issuance of a ticket and receipt by the Company of the applicable fare will be a confirmation of the passenger�s reservation.
4.4 The Company reserves the right to collect a surcharge on the fare paid if an increase has occurred prior to the commencement of travel. There is no guaranteed fare if ticketed in advance.
4.5 Tickets, boarding passes and vouchers are non-transferable.
4.6 Tickets and boarding passes are valid only for the date and time shown on the document, however with a surcharge of $15.00 per person, tickets may be reissued or revalidated for another date or time as long as the Company is notified of the change prior to the scheduled departure time. No show reservations cannot be changed after scheduled departure time.
4.7 The Company reserves the right to refuse to accept any ticket, boarding pass or voucher that has been mutilated, lost, or stolen.
4.8 The Company reserves the right to charge a forfeiture of fare for any ticket issued and not used.
4.9 The Company reserves the right to refuse transportation to a passenger upon payment to said passenger of a refund for any unused portion of the ticket.
4.10 A ticket is considered valid only after it has been properly endorsed by the Company.
4.11 The Company shall not be liable in the event of a ticket�s loss, destruction, or theft, or if the ticket is honored for transportation or refund when presented by any other person.
4.12 Ticket not valid for travel after 12 (twelve) months from date of issue.
4.13 The Company reserves the right to refuse refund requests for any unused voucher or boarding pass.
4.14 The Company reserves the right to deny any refund request received more than ninety (90) days after date of scheduled travel.
4.15 If a passenger fails to occupy space which has been reserved for him/her and the company fails to receive notice of cancellation of the reservation prior to the departure of the service, the company may cancel all reservations held by such passenger for the duration of their trip.

RULE NUMBER 5 � GROUP TICKETS
EFFECTIVE 15 JANUARY 2015
5.1 Group tickets are valid only for departures issued and are non-refundable and non-transferable if not used.
5.2 A group consists of 15 adult passengers or more.
5.3 For transportation, cancellations made 30-15 days prior to travel may be eligible for a 50% refund. Within 14 days of departure, reservations are non-refundable.
5.4 Hotel packages require a 10% nonrefundable deposit at the time of booking. Cancellation policies for hotel packages are as shown on group contracts.
5.5 All passengers must travel on the same itinerary to receive the group fare.
5.6 Reservations are booked in the name of the group.
5.7 A group escort name and contact phone number is required.
5.8 A list of names of all group members is needed seven (7) days prior to departure. Dates of Birth and Citizenship are required for international travel.
5.9 Seattle check-in is required one hour before departure to insure priority boarding status. Due to facility constraints, groups may be boarded with other passengers in Victoria.
5.10 Group escort must check-in on day of travel and distribute boarding passes to the individual group members.
5.11 On board meals may be pre-purchased.
5.12 Each passenger must carry proper identification for clearing customs. Minors must have written parental consent when traveling without parents(s).

RULE NUMBER 6 � CHARTERS
EFFECTIVE 15 JANUARY 2015
6.1 Vessel(s) may be available for charter.
6.2 Any group or individual utilizing 100 percent of the vessel will be considered a charter.
6.3 The full amount of the charter must be paid according to Transportation Charter Agreement terms.
6.4 Deposit must be paid within 10 days of date of Transportation Charter Agreement.
6.5 See Transportation Charter Agreement for terms relating to cancellation and refunds.
6.6 The request for charter must be made in writing stating all of the pertinent details to the Sales Office, Attention: Group Sales Manager.
6.7 Only written quotations will be honored.
6.8 A signed Transportation Charter Agreement is required for all charters.

RULE NUMBER 7 � CHECK-IN REQUIREMENTS
EFFECTIVE 15 JANUARY 2015
7.1 The Company reserves the right to refuse any passenger holding a valid ticket that has not boarded the vessel a minimum of 15 minutes prior to scheduled departure.
7.2 Luggage must be checked and passengers on-board no later than 15 minutes prior to scheduled departure.
7.3 Reservations for passengers not checked-in 15 minutes prior to scheduled departure will be canceled, with forfeiture of entire fare.
7.4 The Company requires all passengers� names before departure. Dates of Birth and citizenship are required for international travel.
7.5 The Company may elect to establish a business class or frequent traveler service/reservation with special check-in considerations.

RULE NUMBER 8 � ACCEPTANCE/NON-ACCEPTANCE OF PERSONS AND GOODS
EFFECTIVE 15 JANUARY 2015
8.1 The Company reserves the right to refuse passage to any person.
8.2 Unaccompanied Minor
The Company reserves the right not to accept any child under the age of 12 years, unless accompanied by an adult passenger. In addition, customs and Immigration advise that persons under the age of 19 years should have the following:
A) Written Parental/Guardian Consent For Travel.
B) Sufficient Funds to Support Themselves.
C) Return Ticket Out Of Country, And;
D) Proof of Citizenship.
8.3 Animals
The Company may not accept for carriage any pets, except by advance reservations. The animal must be in a kennel and accompanied by a paying passenger. EXCEPTION: Service Animals.
8.4 Ski, Snow Boarding and Golf Equipment
The Company will carry ski, snowboarding or golf equipment in limited quantities at the established rate if acceptably wrapped or packaged and advance notice is given. Waiver of liability required from accompanying passenger.
8.5 Bikes
The Company will carry a limited number of bicycles at the established rate, and when prior arrangements are made, and when space is available and after completion of the Bicycle Acceptance and Notification of release form. Bikes will be stored on an outside deck while en route. Waiver of liability required from accompanying passenger.
8.6 Musical Instruments
� Musical Instruments must be packed in an appropriate case for travel (hard sided cases are strongly recommended).
� Musical instruments that are smaller than the carry-on luggage dimensions outlined in Rule Number 11.5 may be carried on board the vessel as the passenger�s one piece of carry-on luggage.
� Guitars or similarly sized instruments can be checked as one of the two allowed checked in items per passenger without an additional charge.
� Larger instruments are subject to cargo charges and will be checked in and handled by Company employees and are subject to space available on board the vessel.
� Fees and handling of musical instruments will be determined at check in.
� Passengers may elect to purchase a seat and carry-on the instrument subject to space availability on board the vessel and approval of the Company management.
� A Musical Instrument Acceptance waiver must be completed and signed by the passenger prior to transport of a Musical Instrument.
8.7 Boxes and other items
Boxes and other items may be accepted for carriage and will be reviewed at check-in for approval and applicable charges. If accepted for travel they are subject to space being available on board the vessel and a waiver of liability may be required to transport such items.
8.8 Firearms and Other Dangerous Goods
The Company will not accept for carriage firearms, ammunition, explosives, or any other form of goods considered dangerous. Any items confiscated by Customs may not be returned.
8.9 Unaccompanied Cargo
Refer to Rule Number 13 for Current Rules and Regulation.
8.10 Wheelchair Passengers
The Company will accept for carriage passengers in wheelchairs, on all vessels. If a wheelchair passenger is unable to care for themselves through the entire trip, they must be accompanied by a qualified attendant who will attend to those needs.
8.11 Peace Officers
The Company will accept for carriage any Peace Officer who may be carrying a firearm, providing the Peace Officer informs the Company (at the time of booking) that the officer will be traveling on official business, with the sanction of the government agencies of the countries that are involved.
8.12 Luggage
Refer to Rule Number 11 for Luggage allowances

RULE NUMBER 9 � CLAIM FOR PERSONAL INJURY, OR LOSS OF LIFE
EFFECTIVE 15 JANUARY 2015
9.1 The Company will not be responsible for any personal injury on-board the vessel or otherwise which is not reported to a member of the crew, or to a ticket agent by the passenger prior to leaving the Company premises.
9.2 A completed Clipper Navigation, Inc., injury report must be submitted by the passenger prior to leaving the Company premises.
9.3 Time Limits for Asserting Claims
In any case governed by 46 United States Codes Section 183b, which is a United States statue that permits any ship owner to limit the time during which a passenger may file a claim or commence suit against a ship owner, a person may not maintain a lawsuit against Owner for loss of life or bodily injury unless written notice of the claim is delivered to Clipper Navigation, Inc. no later than six (6) months, and the lawsuit is commenced not later than one (1) year, after the day of death or injury. For all other claims including but not limited to claims for loss or damage to baggage, breach of contract, illness or death or injury not governed by 46 United States Code Section 183b, a person may not maintain a lawsuit against Owner or Ship nor will Owner or Ship be liable therefore, unless Clipper Navigation, Inc. is provided with written notice of claim within 30 days from the date the claim arises and the lawsuit for such claim is commenced not later than one hundred eighty (180) days after such date.
9.4 Governing Law; Venue
This contract is issued at Seattle, Washington and will be construed in accordance with the general maritime law of the United States. All disputes and matters whatsoever arising under, in connection with or incident to this contract shall be litigated, if at all, in and before the United States District Court for the Western District of Washington at Seattle or in the courts of the State of Washington, U.S.A., to the exclusion of the courts of any other state or country.

RULE NUMBER 10 � OPERATION OF THE VESSEL
EFFECTIVE 15 JANUARY 2015
10.1 The Company will not accept any liability arising from an alteration in the published schedule or route.
10.2 The Company does not guarantee that the service shall start or arrive at the time stated in the schedule and will not be liable for any additional costs incurred by the passenger as a result of any delay.
10.3 The Company may cancel any scheduled operation if in its opinion the safety of the passengers, crew, or vessel could be in danger.
10.4 The Master of the vessel will be considered the ultimate authority whenever the vessel is in operation.
10.5 The liability of the Company will cease when passengers and other traffic are landed at any port.
10.6 The Company reserves the right to substitute a vessel or cancel any operation entirely if it becomes necessary for any reason beyond the control of the Company.
10.7 The Company will not be held responsible for injury, loss, or damage that shall result from an act of God, public enemy, or any other such acts.

RULE NUMBER 11 � LUGGAGE ALLOWANCE
EFFECTIVE 15 JANUARY 2015
11.1 Each adult fare passenger will be allowed 2 pieces of checked luggage, not exceeding the overall dimensions of 36� x 10� x 28� (length x width x height) or 74 linear inches and each no heavier than 50 pounds.
11.2 Additional luggage will be allowed at the cost of $10.00 per segment, per piece (up to 4 pieces) providing there is space available. Passengers with more than 4 pieces of luggage per person may be accepted on a case by case basis and will be charged cargo rates.
11.3 Luggage in excess of 50 pounds will be allowed at the cost of $10.00 per segment, per piece providing there is space available.
11.4 Luggage in excess of 70 pounds will be considered freight and will be accepted as Clipper Cargo.
11.5 Each adult fare passenger will be allowed one piece of carry-on luggage, not exceeding the overall dimensions of 22� x 14� x 9� and no heavier than 20 pounds. The Company disclaims liability for loss or damage to carry-on baggage.
11.6 Golf clubs, skis and snowboards may be checked as one of the two pieces allotted to a passenger. If passenger already has two pieces of luggage to check, the golf clubs, skis or snowboards will be accepted at the cost of $10.00 per segment, per piece.
11.7 Non luggage items may be accepted on a case by case basis and will be charged cargo rates.

RULE NUMBER 12 � LUGGAGE LIABILITY AND ACCEPTANCE
EFFECTIVE 15 JANUARY 2015
12.1 The Company can refuse to carry any article that is considered harmful or dangerous to the Vessel, passengers, crew, or other goods being transported.
12.2 Any article that by its nature would be considered contrary to the law of the land of either country will not be accepted.
12.3 The Company is not liable for any loss or damage to luggage that is not a direct result of gross negligence on the part of the Company�s employees or its representatives.
12.4 The Company will only be liable for a claim for loss or damage not exceeding $250.00.
12.5 The Company will not be liable for any loss or damage to luggage that is not reported in writing prior to the passenger leaving the Company premises.
12.6 The Company reserves the right to not carry any personal luggage that is not securely fastened.
12.7 The Company assumes no responsibility and will not be liable for loss of or damage to protruding parts of luggage and other articles of checked baggage, including, but not limited to, wheels, feet, pockets, hanger hooks, pull handles, straps, zippers, locks and security straps. Furthermore, The Company assumes no liability for defects in baggage manufacture or for minor damage arising from normal wear and tear, such as cuts, scratches, scuffs, stains, dents, punctures, marks and dirt.
12.8 Clipper Navigation, Inc. assumes no liability for any personal items that are packed or stored within checked or carry-on passenger baggage. This includes, but is not limited to: cameras, computers, jewelry, cash, strollers, documents, medications, and other similar high valued items. Such items are the sole responsibility of the passenger.

RULE NUMBER 13 � CLIPPER CARGO
EFFECTIVE 15 JANUARY 2015
13.1 Clipper Cargo is a freight service offering carriage between Seattle and Victoria.
13.2 Clipper Cargo can carry anything from a small package to a 2,000 pound pallet.
13.3 Clipper Cargo does not perform Custom brokerage service nor is it responsible for applicable Duty, Custom Fees or Taxes. A brokerage firm can be recommended.
13.4 For current rules and conditions of carriage refer to reverse side of the Bill of Lading.
13.5 For current rates refer to current published brochure.
13.6 Excess cargo will be allowed as space is available.
13.7 Animals or livestock will not be transported as cargo.

RULE NUMBER 14 � THIRD PARTY LIABILITY
EFFECTIVE 15 JANUARY 2015
14.1 The Company is responsible to you in making arrangements for the tour services offered in our current brochure, including transportation, sightseeing, and hotel accommodations. The third party carriers, hotels, and other suppliers providing services are independent contractors and are not agents, employees, or servants of, or joint ventures with the Company or its affiliates.
14.2 All certificates and other travel documents for tour services issued by the Company are subject to the terms and conditions specified by the supplier and to the laws of the countries in which the services are supplied.
14.3 If after the tour departure, the services included in the tour cannot be supplied or there are changes in an itinerary for reasons beyond the control of the Company, the expense will be payable by the passenger.
14.4 The Company reserves the right to withdraw any overnight package at any time and to make such changes and alterations as may be found necessary for the proper handling of said overnight packages.
14.5 Prices Include:
Transportation as specified in the itineraries.
Accommodation, Sightseeing and Meals as specified in the itineraries.
Applicable taxes and fees.
14.6 Prices Do Not Include: Insurance of all kinds; phone calls; beverages; meals not detailed in the itinerary; gratuities to taxi, courtesy van, or tour drivers; items of a personal nature; excess baggage; optional excursions; etc. The tour price also does not cover costs and expenses, including the return to your home, if you leave the tour at your own volition, or due to illness, or as a consequence of official action by the government of any country visited.
14.7 No refunds will be made on unused tours, transfers or accommodations when voluntarily canceled or omitted by the passenger, or for missed package features due to airline or other third-party-transportation providers� delays or for other acts beyond our control.
14.8 Travel Agents and Tour Operators: The Company is not responsible for the financial conditions or integrity of any travel agent or tour operator utilized by the passenger in connection with the Victoria Clipper and services provided by the Clipper. In the event that a travel agent or tour operator fails to remit to us any monies paid by you to the travel agent or tour operator, you remain liable for the fare due us, regardless of whether we demand payment before or after initial departure. Any refund made by us to a travel agent or tour operator on your behalf is considered, for purposes of this contract, as being the same as payment to you whether or not the monies are delivered by the travel agent or tour operator to you.
14.9 The Company shall not be held liable for loss of or damage or injury to property, or injury to person caused by reason of any:
1. Defect, negligence or wrongful act of omission by any other transportation company, any hotel, any agency or any such party providing such services or facilities; and
2. Strike, war, weather, quarantine, sickness, government restrictions or regulations, or any other cause beyond its reasonable control.

ALASKA FERRIES: Terms and Conditions of Passage When Travelling on Alaska Ferries (AMHS)
"Passenger" and "you" mean person(s) identified in this ticket. By accepting this ticket, you agree to following terms and conditions:
1. You consent to security screening and inspection of your person, vehicle, and property. If you revoke consent at any time, if you fail to comply with federal, state, or local laws, or if you fail to abide by instruction from State personnel regarding travel, security, health, safety, welfare and related matters, State of Alaska (State) may remove you, your vehicle, and your property from its premises or vessel.
2. Passengers with vehicles must check in at terminal by time fixed by State. Pedestrian passengers must check in at terminal one hour prior to vessel departure and be aboard at least 15 minutes prior to departure or risk being denied transportation.
3. All passengers aged 18 years or older must present valid, government issued photo identification prior to boarding.
4. When transporting pets into Alaska, you must present a valid health certificate for each animal before State will permit boarding.
5. PROVISIONS AFFECTING OR LIMITING LEGAL CLAIMS. READ CAREFULLY.
a. State, as well as its employees and agents (personnel), are not liable for any claim arising in connection with passenger death, illness, or bodily injury unless made in writing and lodged with Office of Attorney General, P.O. Box 110300, Juneau, AK 99811-0300 within six months from date of death, illness, or injury. Failure to lodge a claim in this manner will preclude any later suit related to such claim(s). Additionally, any person intending to file suit against State or its personnel in connection with such death, illness, or injury - or any other matter - must file suit within one year from date of death, illness, injury, or event giving rise to any other claim. State and its personnel are not liable for any claim filed after one year.
b. State and its personnel are not liable for emotional distress, mental suffering or psychological injury unless the distress, suffering, or injury has resulted from: (a) physical injury to claimant through negligence or fault of a crew member, managing agent, master, owner, or operator; (b) claimant having been at actual risk of physical injury, and such risk was caused by the negligence or fault of a crew member, managing agent, master, owner, or operator; or (c) intentional infliction by a crew member, managing agent, master, owner, or operator.
c. Any person asserting a claim arising in connection with this ticket or passenger's travel shall file and litigate the claim in a court located in Alaska, to the exclusion of courts of all other states and countries. Federal maritime law shall apply regarding any such claim or dispute. However, if federal maritime law cedes to state law concerning a particular subject, Alaska law will apply to that subject.
d. State reserves the right to alter, revise or cancel schedules and rates for any reason without prior notice and is not liable for any resulting delays, expenses, or damages passenger may incur; nor is State responsible for arranging alternate lodging or transportation.
e. State and its personnel are not liable for theft from any person, vehicle, baggage, or other property at terminal facilities or on vessels.
f. If a court should rule any provision of this contract invalid, the ruling will not affect or invalidate any other provision.
